First CAPA Meeting Minutes - [Not yet complete and approved]

The first organizational meeting of CAPA - Citizens Against Political Assassination was held via telephone conference call on the afternoon of Saturday March 28, 2015, hosted by the Wecht Institute of Pittsburgh.

Dr. Wecht opened the proceedings by suggesting we broaden our leadership to include some women and people of color as we need diversity and can't just be an association of liberal white guys.  (In response a list of women to invite was started see Notes:1).

We also invited people from Texas and the international community but they couldn't make it but will be part of future meets, especially on sub-committee meetings via skype.

The basic structure of the organization was agreed on - with four general membership regions and five focused committees -  Legal, Advisory, Media-PR, Research and Fiscal-Membership.

Peter Dale Scott, who is on book deadline and sent his regards, will head up the Advisory Committee that will review all strategies, proposals and programs before they are considered by the Executive Commitee.

The Executive Committee will consist of the ten people who were in on the original conference call, plus anyone they desire to invite to the next meeting.

Bill Kelly will head up the Research Commiteee, with assistance from Mike Nurko, who also agreed to be on the Fiscal Committee, and Brian Hamilton, who listened in but did not participate, but will assist the PR-Media Committee. The Resarch Committee will be responsible for continuing the on-going dialog with the NARA staff and attempt to engage the leadership of the Archivist of the USA, Judge John Tunheim, Jeremy Gunn and others to press Congress for oversight and complete enforcement of the JFK Act. The Research Committee will also work closely with the Legal Action Committee in developing FOIA and Civil suits and support of those actions that are on-going.

The Legal Action Committee - led by Bill Simpich and assisted by Dr. Wecht, Patrick McCarthy, Dennis Bartholomew, Larry Schnapf and others will devise three 501-3c non-profits - one Political Action Committe, one Super-PAC, neither tax deductible because they will endorse candidates and issues and be used to sue the government, and a third Educational and Research Foundation that will not be political and will be tax deductible. The Legal Committee will work with the PR-Media and Fiscal Committee to increase membership, donations and fund raising events in order to generate the funds needed to support our activities.

While the Legal Action Committee will get the first financial support for FOIA and filing fee appeals, the PR-Media Committee is getting the most responsibilities in devising a media strategy that will work. There was a discussion of placing a full page advertisement in the New York Times, and that is being considered, but it was agreed that the money can be better spent, especially as we get organized.

Jerry Policoff said that he would contact Marie Fonzi and invite her to participate in the next meeting of the Executive Committee, set up a Google Group account for the Executive Committee and PR and lead the PR-Media effort with assistance of Andrew Kreig, Bill Kelly and a suitable committee where the work can be spread around.

Bill Kelly is preparing a Press Release announcing the formation of the organization, and the Social Media program content is being organized.

Agreed to name a Board of Directors and an Advisory Committee - trying to get 1 or 2 prominent people to be on the committee, such as Oliver Stone, RFK Jr. and possibly approaching Caroline or approaching others in the Kennedy family. (others may include Martin Sheen, Kevin Costner and Ed Asner)

Agreed to have an Executive Committee and set up other committees: Legal Action Committee, Research Committee, P R Committee, Membership Committee and a Fund Raising Committee.

Agreed to support the enforcement of the JFK Act, including exhumation of the body. Having a hearing in DC at a federal building with prominent speakers.

Agreed to support the various FOIA suits as well as future suits and legal actions.

Discussed the problem of the media not covering our previous events and findings, and the need to get 2 or 3 prominent newspaper writers to break the ice.

Discussed having a Public Inquest.

Discussed getting possible whistle blowers and approaching the children of various suspects, who may have relevant information.

Seek support from Marie Lopez and have her speak at a CAPA event or conference.

Great call. Thanks for organizing it. I wrote down some strategic thoughts while we were talking that I thought I would share with you. Feel free to share with others as you see fit. I'm the newbie to this group so defer to judgment of you and others. 

1. should we consider adding the word "secrecy" or similar term to the name of the committee/ business name to emphasize connection with current times so we can show relevancy to the younger generation,  libertarians, and conservatives concerned about individual rights/freedom?

2. form the 501(c) organization so we can be open for business. We would need to select business name, state of incorporation, initial directors, apply for state and federal exemptions, draft bylaws, etc.

3. Identify group who will reach out to Kennedy children (maybe first RFK and Kathleen Kennedy Townsend). Find out what they would be looking for from
us to get their open support. Also to let friends of the family know its ok
to cooperate and support us. I'm sure David Talbot knows this drill well.

4. Identify group to reach out to children of CIA or other government
employees who may have had knowledge of events/cover-up and want to "do the right thing" that their fathers were unable, could not or were prevented from doing.   

5. Identify group to reach out to Hollywood (Stone, DiCaprio, etc.) who can bring attention to our effort.

6. Form social media group to formulate media campaign

The full enforcement of the JFK Act and the release of all assassination records is one of the priorities of CAPA - Citizens Against Political Assassinations - a new Political Action Committee that also intends to file FOOA and civil law suits against the government, make open records/ government secrecy a campaign issue and bring the subject of political assassinations into the mainstream media.

"We oppose political assassinations as a means of obtaining and maintaining power," said Dr. Cyril Wecht, CAPA chairman, "and we are determined to seek truth and justice and educate the public of the dangers assassination poses to our society."

"We already won the hearts and minds of the American people on the need for full disclosure and accountability," said San Francisco attorney Bill Simpich, "now we have to win the political battle to see that the law is enforced and the Constitution is upheld."

"We have two more years to obtain full disclosure in the JFK case," Simpich said, "and if we want to succeed we have to make full disclosure of our nation's secret history a central issue in the presidential election."

According to the JFK Act the next president will decide in October 2017 whether to continue to keep JFK assassination records secret or release the remaining records still being withheld for reasons of national security.

Not just a few records - there are so many documents still being withheld the National Archives - NARA can't tell us how many,

We believe it is now in the interests of our national security to release all of the remaining sealed records so according to the JFK Act, the people can make up their own minds as to what happened at Dealey Plaza and what to do about it.

Political assassination is the most serious threat to democratic government and it occurs some where every day, usually as a convenient means of maintaining and controlling power. That’s why it is important to support those who focus on and study political assassinations as a
tactic that must be opposed.

We want to live in a country where murders will not go unpunished and where the democratic processes cannot be frustrated by individuals, agencies or organizations who oppose the popular will and violate the Constitution.

Five decades of independent research has demonstrated that the American system is unable to effectively address crimes which have the potential of exposing groups and motives with radical and socially explosive motives. There is strong evidence that lead key decision makers compromised investigations and manipulated official conclusions at both the state and national level. Examples of such compromised legal inquiries include the assassinations of John and Robert Kennedy, Dr. Martin Luther King Jr. and Medgar Evers as well as domestic terror attacks such as the Oklahoma City bombing and 9/11.

The result of those compromised investigations has been an ongoing decline in confidence in both the American legal process and the credibility of the institutions involved. Until the nation moves to honestly deal with such crimes and their implications that loss of faith will continue to both undermine the nation’s faith in its own character.

50 years have passed since the Warren Commission declared that Lee Harvey Oswald was the lone assassin in the murder President John F. Kennedy. During those decades, independent researches, authors, medical and ballistic experts continued to expose the hard evidence that proves the official government conclusion is invalid. We now know that:

- The official investigations were flawed and important leads never properly pursued.
 -  Significant unanswered questions remain in other political assassinations, such as those of Robert Kennedy and Martin Luther King.

- Most people believe with good reason that one man alone could not be responsible for these crimes.
- The truth remains hidden as long as the government records on these assassinations remain sealed from the public.

Some people may feel that there is no purpose in working to solve murders that date back fifty years, but we know there is no time limit on the truth and no statute of limitations in a murder case. Until we face the truth about the assassinations of our political leaders we cannot hope to move toward a viable democracy in this country, nor prevent such assassinations from happening. No other event has changed the shape of the future in the same way as the assassination of President Kennedy and we can wait no longer for a solution and we must act now.

The mission of the Coalition against Political Assassination (CAPA) is to establish the truth about assassinations and major crimes of political significance.

In order to achieve that goal, CAPA will:

- Pursue the release of withheld records with both the National Archives and Congress, identify and obtain the release of missing, lost, allegedly destroyed and currently withheld and unavailable records and make them as widely available as possible.

- Work closely with the NARA and get Congress to fulfill their oversight mandate by holding public hearings and ensure the full disclosure of the remaining sealed records.

- Initiate a similar process to release the records in other assassinations, especially the HSCA MLK files that remain sealed and weren’t covered by the JFK Act.

- Analyze the new records and educate the American people about who commits political assassinations, who covered up the conspiracies and why.

- Establish investigative teams to thoroughly review and critique the evidence now available and identify any potential political conspiracies associated with the crimes.

- Engage in a public/media effort to correct the impression that the previous inquires and official verdicts are necessarily correct and can be taken to represent the historical truth of the crimes.

- Correct the media spin that says there is nothing new in these records.

- Answer the outstanding questions that can be answered.

- Find the historic truth

- Seek justice.

The ultimate goal of this work will be an effort to seek both truth and justice in regard to any crime which can be shown to have been an act of political assassination.

There are hundreds of non-profits organizations and think tanks that study war and peace and promote democracy but only a few that focus on political assassinations as the biggest threat to the legitimacy of the government.

Recent polls show that 85% of the American people agree with us about the evidence of conspiracy in this case and the need to release all of the remaining withheld records. They know they have never been told the full story by the official investigations. We need your help to reach them and to let them know that something can and must be done. Help us reveal the truth and tell the American public that there is something new in these files and something can be done about it.

Now there is an organization that supports the latest research, uses grassroots outreach and social media, is lobbying Congress for oversight hearings, using the courts to free secret files and is forcing the rule of law in political assassinations.

This is your organization. Working together we can make a difference now.

CAPA Committees

The first Executive Committee members have agreed to form five committees: 

          - Legal Action Committee (LAC) of attorneys, who will also handle CAPA’s legal papers as a 501(c)3 not for profit Political Action Committee – PAC – donations to which are not tax-deductable because we can endorse political candidates, advance partisan issues and sue the government, which we intend to do. San Francisco attorney Bill Simpich will lead the LAC with assistance of a strong legal team.

       -    Research - Independent Research Associates (IRA). Bill Kelly will continue engaging NARA staff

      - PR - Public Relations Committee that will be based on East Coast in Washington D.C. and be responsible for devising a mass media campaign strategy and implement it via newsletter and social media to call attention to our issues and gain public support.

-          Fiscal Committee that will raise money and create a budget for special projects that are proposed by committees and approved by the Ex Com.

So far we have eight to ten people to serve in each region and on each committee and we should begin to publicly announce the formation of CAPA and recruit new members soon. We will have an open registration for a short while so those we know and have worked with in the past can join and then seek public memberships, patrons, sponsors and supporters.

Members of a regional or special committee will be asked to complete certain tasks suited to abilities, participate in the discussions, cast votes on issues and contribute to the achievement of our goals and the successful completion of our mission.

CAPA COMMITTEES and their Responsibilities

Legal Action Committee – the LAC is responsible for drawing up the CAPA Charter and oversee the official filing of legal papers and tax forms as well as filing civil court suits under the CAPA name, advise researchers in their private suits and provide legal services to committees and members.

Research – Independent Research Associates (IRA) – Independent researchers committee will engage Congressional and the National Archives and Records Administration (NARA) staff, assist the LAC in detailing and establishing the facts of each case and follow up on leads presented to it by committees and members. The Research Committee will serve as CAPA Liason to both the NARA and Congress.

Public Relations – will be based on East Coast - Washington D.C. and be responsible for all mass media, social networking, daily and weekly updates of new research and news, a monthly newsletter and all publications and advertising, as well as devising a multi-media campaign strategy to promote our issues and candidates.

Fiscal – the sole and soul purpose of the Fiscal Committee will be to promote all of the above, ensure that the Committees have the money needed to achieve our goals and succeed in the mission that the members have pledged to complete. The Fiscal Committee will be responsible for membership dues and donations, seeking partners and the financial support of patrons, sponsors, grants and foundations.

As you know we are re-organizing COPA as CAPA for a number of reasons – the loss of its coalition status by the withdraw of two of the three founding organizations, the death of long time director John Judge, and the co-mingling of COPA funds with the newly established Hidden History Museum.

Former COPA Board members at the Bethesda conference said they would support continuing COPA only if had a new name, new leadership and didn’t duplicate the activities of other, similar organizations.

We therefore have changed the name to more reflect the nature of our association as individuals with common goals and tolerant enough to accept different perspectives.

Most of COPA’s funds over the two decades went towards the production of yearly conferences in Los Angeles, Memphis and Dallas and the maintenance of the COPA archives, which are now part of the Hidden History Museum being established in Washington.

Without having to maintain any bricks and mortar, pay rent or produce conferences, CAPA members can channel their funds and energy towards research, FOIA requests and civil suits against the government, see to the oversight of the JFK Act and monitor the release of the records through at least October 2017, when the last remaining JFK assassination records will be released.

At the suggestion of our new lead attorney Bill Simpich, we will keep the organization structure small, with a four person Executive Committee – each representing one of four regions – East Coast – centered in Washington D.C., Mid-West centered in Dallas, West-Coast centered in San Fran and International – Centered on the Internet.

Each Regional Representative will have one vote on the Executive Committee, but since most issues will be long thought out proposals they should be approved by consensus, so the Chairman will only have to vote in case of a tie.

Dr. Cyril Wecht has agreed to stay on as Chairman of the Executive Committee and his son Ben will be asked to host the first conference call meeting of the Ex Com as soon as it is feasible.

Michael Nurko, a long-time COPA supporter will represent the East Coast at the first meeting of the Ex Com, while Gary Aguilar will be asked to represent the West Coast and Robert Groden, Tom Blackwell and Frank Caplet, who represented COPA at the Grassy Knoll on November 22, will decide who will represent the Mid-West.

An International Representative has yet to be chosen, but we are working on it, but in any case, after the official establishment of the organization at the first meeting, each region will choose their own representative for the Ex Com, which will meet once monthly or whenever necessary.

Attorney Bill Simpich has stepped forward and will help draw up the CAPA Charter and file official 501(c)3 tax papers establishing CAPA as a not-for-profit Political Action Organization that is not tax-deductable but permitted to endorse candidates, advance issues and sue the government, which we intend to do frequently.

Patrick McCarthy, Dennis Bartholomew and a few other lawyers will assist Simpich and formulate a Legal Action Committee that will oversee support for FOIA and civil action suits against different agencies and departments of government and maybe individuals.

I will represent the non-voting Research Committee at the first meeting, and along with other Ex Com members introduce for approval some proposals and measures that we have been working on, form new committees and focus groups and adopt a Mission Statement and budget.

An agenda for the first meeting will be forthcoming.

Peter Dale Scott will be asked to head up the Advisory Board, at least for the first meeting, while after the first meeting I will resign as representative of the Research Committee, hand it over to a researcher from Washington and take up the post of CAPA Security, with the job of seeing that we are not threatened, disrupted or kept from completing our goals and mission.

After the first mission each Region and Committee can chose their own representative on the Ex Com but only the four region representative will have voting power since committee members are already represented regionally.

While CAPA will be an open and inclusive organization that hopes to attract and recruit thousands of similar minded citizens, in order to more easily manage things we will have a broad popular base but a small Ex Com to make decisions, and the Ex Com will be selected by a Regional Committee made up of ten to twelve nominated volunteers drawn from the memberships of each region.

These sub-committees will consist of those with the knowledge and time to devote to special projects, research, legal issues, public relations and political action – we are, after all, a political action organization and we intend to be busy.

As we have learned in the past this issue attracts its share of loonies, who along with the Lone Nutters and weird conspiracy theorists there is the real opposition – those who commit political assassinations with impunity, who will certainly take exception to our work. That’s why an umbrella organization like CAPA is necessary – to protect the independent researcher who works out in the field and not only doesn’t get paid for it, doesn’t have the financial and administrative support that the government and corporate world provides. CAPA can fill that void, give support to independent researchers and writers, file FOIA and civil suits under the CAPA name, endorse candidates and make open records a campaign issue.

As our legal team has suggested, we will propose and adopt a three year plan with achievable goals that we can accomplish. 

After Legal and Research, the Ex Com will approve the establishment of other committees as it needs, including Public Relations, Fundraising and individual case committees – MLK, RFK, etc., and you can plug yourself into any committee you want to be a part of.

This should be the last mass mailing – as we will shift to more personal, private and secure interactions soon.

A number of CAPA founders are working on important new issues and three former COPA members -John Newman, David Talbot and Jeff Morley are now polishing up years of research into books that when published in 2015 should greatly advance our knowledge of the JFK assassination. They all promised to join us in these efforts as soon as they are finished their present tasks.

I am looking forward to working with all of you over the next three years creating political havoc in Washington by achieving the goals and completing the missions we set out to accomplish twenty years ago, and hope you are looking forward to the battles ahead.

CAPA Charter – Citizens Against Political Assassinations (CAPA)

The Citizens Against Political Assassinations (CAPA) is a not-for profit association of responsible and educated citizens who study and oppose assassination as a political tactic and is committed to exposing the truth about and seeking justice for those victims of political assassination.

CAPA will be aggressively lead by an Executive Committee of seven members including a chairman (Dr. Cyril Wecht) and a representative of each of the four regions – DC, Dallas, West Coast and International, and begin with two committees  - Legal Action Committee of lawyers and an Association of Independent Researchers (IRA), with the two committees being closed – admission is by invitation only.

There will also be a Board of Advisors that will be included in all decisions and include all former COPA – Coalition On Political Assassination board members - Peter Dale Scott, Bill Turner, Jim Lesar, et al.

The legal committee will be closed, by invitation and include only lawyers active on FOIA or civil or criminal cases involving political assassination –  Bill Simpich, Patrick McCarthy, Dennis Bartholowmew, Cyril Wecht, Mark Lane, Robert Tannenbaum, James Lesar, Ed Lopez, Dan Hardway and Charles Sanders will be invited to be on the LAC, but the committee members themselves will decide who is on the committee.
